THE NEW NEED REGULATIONS ARE OUT FOR PUBLIC COMMENT!

CDE has published its proposed new "Need" for child care regulations for public comment.  CCDAA will be providing comments, and invites members to send in their comments to CCDAA for consideration in compiling the comments from CCDAA.  Members are also welcome to send their comments directly to CDE (the address and directions are listed below).  Please see the attachment for the proposed additions and changes to Title 5 regulations, and other information from CDE about the proposed regulations.  The added or changed portions of the regulations are underlined.  Language in the current regulations that is not being changed is in regular type and not underlined.  Language in current regulations that is proposed to be deleted is crossed out.

These proposed regulations cover the requirement that parents document a "need" for child care, as well as "eligibility", before a CDD contractor can approve the family for child care.  (A sort of exception is "child protective services" children -- a proper referral for CPS child care meets both the eligibility criteria and the need criteria.  Revised rules for CPS cases were included in the proposed "eligibility" regulation changes, which were already released for public comment.  It is already past the deadline for comment on those proposed regulations.)

Comments to CCDAA are due by February 23 for consideration in CCDAA's comments.  You should return your comments to Nina Buthee, Executive Director, at nina@ccdaa.org, or fax them to (916) 443-5919.
[Comments directly to CDE must reach CDE by 5:00 pm on March 16.]

We encourage members to:
     1.  Identify changes that you like, as well as changes you do not like.
     2.  If you do not like a change, explain the problem that you believe would be created by the change from the current regulations.
     3.  If you do not like a change, tell us what language, or what concept, you would like to see in the new regulations.
     4.  If you have a good idea regarding the "need" regulations that CDE did not include, you can also propose that idea to CCDAA.

This is the 2nd "package" of regulation changes that is part of the "Error Rate Study (ERS) Regulations" process.  The 1st package, which is close to adoption but has not yet become official, was the "Eligibility" package.  The packages still to come are:  provider payments, parent fees, fraud (prevention and reduction), and miscellaneous.
